Müller v. Lodge & Davis Machine Tool Co.
Description:
The lawsuit Müller v. Lodge & Davis Machine Tool Co. involved this patent: Müller sued Lodge & Davis for infringing. It was agreed that Lodge & Davis's tool holder was similar but not identical in design. The court then focused on the question of whether Müller's patent claims should be interpreted strictly or more generally. Evidence was presented that each element of the invention was not new, and from that the court concluded that only the strict combination of elements could be patentable and therefore Lodge & Davis's tool holder did not infringe. That was the decision of the circuit court, and it was upheld by the appeals court.
