American Whip Co. v. Lombard
Description:
This patent was subject to litigation in American Whip Co. v. Lombard (see link). American Whip Co. had licensed this invention which covers a device to hold a whip-stock while being shaped and smoothed. The defendant was aware of the patent machine and sought to evade this patent by substituting one mechanism with an equivalent one. The court found that the substitution was an obvious one and still infringed this patent even though it only covers the combination of mechanisms to achieve the desired result. Note that we do not include American Whip Co. as a manufacturer of this patent because so far as we are aware, they used the patent machine but did not manufacture them.
